In my 32nd year of practice as a trial lawyer, I continue to embrace new techniques while refining those that have served me well in effectively shaping and presenting disputed matters to accomplish successful results for my clients.

Whether engaging in pre-litigation negotiations, alternative dispute resolution proceedings, trying a case before a judge or jury, or arguing appellate matters, I meticulously digest complicated factual and legal issues and convert them into a compelling and persuasive presentation.

In both private and public practice, I have successfully handled litigation matters including catastrophic personal injury, products liability, public entity liability and immunity, and insurance fraud. My insurance fraud and coverage experience spans product lines including commercial, automobile, life, home, disability, marine, and health care.

In the formative years for interpretation and application of the Insurance Fraud Prevention Act, the standard of proof for an IFPA violation had to be established in order to make it an effective tool for quashing insurance fraud, so too the proof problems associated with addressing the defendants’ state-of-mind had to be effectively addressed. I played a role as an advocate in the path finding cases that established those standards while a New Jersey Deputy Attorney General. I continue to apply those precedents currently on behalf of my insurance carrier clients and advocate for the continued evolution of the IFPA as an effective fraud fighting tool. I have supervised and trained both attorneys and investigators regarding the identification of insurance fraud and the strategic presentation of such cases.

Prior to joining the Firm, I was the Lead Deputy Attorney General for New Jersey’s Insurance Fraud Section where I handled civil trial and appellate litigation for the State.

As a Deputy Attorney General, I also was a member of the Tort Litigation Section, providing personal injury defense representation in catastrophic injury and death cases for state entities including New Jersey Transit, the New Jersey State Police, and the New Jersey Department of Transportation, among others, in state and federal courts.

For the Banking and Insurance Section, I handled administrative, trial, and appellate matters including the establishment and defense of care-paths, insurance rate-making litigation, producer discipline matters, and insurance fraud matters and served as counsel to the New Jersey Joint Underwriting Authority (“JUA”) and the New Jersey Market Transition Facility (“MTF”).

Representative Matters

  • Represented a major health insurance carrier against a medical provider regarding allegations of unbundling, upcoding, misrepresenting charges, waiving patient’s shared financial responsibility, and paying kickbacks to referring physicians resulting in a confidential settlement without an admission of responsibility;
  • Represented a major health insurance carrier against an ambulatory surgery center for recovery of insurance benefits paid in the context of allegations regarding ownership, licensing, waiver of patient’s share of financial responsibility, and billing issues resulting in a confidential settlement without an admission of liability;
  • Represented a major health insurance carrier against an electrodiagnostic monitoring company in the context of allegations of improper ownership, the unlicensed status of the supervising physician, and the qualifications of technicians resulting in a confidential settlement without an admission of liability;
  • Represented a major health insurance carrier before the Department of Banking and Insurance regarding an inquiry into alleged unfair claim practices resulting in no disciplinary action being taken against the carrier;
  • Represented a major health insurance carrier regarding claims by a multi-physician cardiology and cardiovascular surgery practice of underpayment of claims and negotiation of the reimbursement terms going forward resulting in a confidential resolution of the dispute without an admission of responsibility.
